Article 2 – Subject

The subject of this Preliminary Information Form is to inform the Consumer, in accordance with the provisions of the Law on the Protection of Consumers and the Distance Sales Regulation (published in the Official Gazette dated 27.11.2014 and numbered 29188 in Turkey), regarding the rights and obligations of the parties concerning the purchase and sale of goods/services carried out electronically through the website www.cerisier.com.tr, and the related contract.

Article 3 – Product/Service Information

The basic features of the goods or services subject to the contract can be found at www.cerisier.com.tr. The prices listed and announced on the website are the sales price including all taxes. The announced prices and promises are valid until updated or changed. The prices announced for a specific period are valid until the end of the specified period.

Article 4 – Payment and Delivery

Payment Method: Credit card or debit card

Delivery Address: [The address provided by the Buyer]

Delivery: The purchased product(s) shall be delivered to the address specified by the Consumer, through the contracted courier company, within the legal period not exceeding 30 days. If delivery cannot be made within this period, the Consumer will be notified in advance.

Shipping Fees: Unless otherwise stated, shipping costs shall be borne by the Consumer and will be reflected separately on the order summary.

Article 5 – Right of Withdrawal

The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the product without stating any reason and without paying any penalty. In order to exercise the right of withdrawal, the SELLER must be notified in writing (via registered mail, e-mail, or fax) within this period. The product must be returned in its original packaging, undamaged, complete, and unused.

If the BUYER exercises the right of withdrawal, the SELLER shall refund all payments received, including the delivery costs (if paid by the BUYER), within 14 days at the latest from the date of notification of withdrawal.

Products that are prepared in line with the Consumer’s requests or personal needs, goods that are not suitable for return due to health and hygiene reasons and have been unsealed after delivery, and products that are mixed with other products and cannot be separated due to their nature, cannot be returned.

Article 6 – General Provisions

6.1. The BUYER declares that they have read and understood the preliminary information on the basic characteristics of the product, the sales price, payment method, and delivery, as shown on the SELLER’s website, and that they have provided the necessary confirmation electronically.

6.2. By confirming this Preliminary Information Form electronically, the BUYER confirms that they have obtained the correct and complete address, basic features of the ordered product(s), product price including taxes, payment and delivery information, and the right of withdrawal.

6.3. If the product(s) cannot be delivered to the BUYER due to force majeure or extraordinary circumstances such as adverse weather conditions or transportation interruptions, the SELLER shall notify the BUYER. In such cases, the BUYER may cancel the order, request a replacement product, or wait until the delivery barrier is removed.

6.4. If the BUYER cancels the order, the payment will be refunded within 14 days from the date of cancellation, using the same payment method employed by the BUYER.

Article 7 – Governing Law and Jurisdiction

This contract is subject to the laws of the Republic of Turkey. In case of disputes arising from this contract, Consumer Arbitration Committees up to the value declared by the Ministry of Trade, and Consumer Courts for values above, located where the Consumer resides or where the transaction took place, are authorized.

Article 8 – Enforcement

This Preliminary Information Form shall enter into force once it is confirmed electronically by the BUYER prior to the conclusion of the distance sales contract. The BUYER is deemed to have accepted all the terms herein by approving this form electronically.
